Adams County Sheriff Charged With Misuse Of Public Funds

(Boise) – The Idaho Attorney General’s Office filed a criminal complaint today charging Adams County Sheriff Richard Leo Green with six felony counts of misuse of public money in violation of Idaho Code Section 18-5701. Sheriff Green is also charged with three felony counts of presentation of fraudulent accounts in violation of Idaho Code Section 18-2706.

The allegations in the complaint are as follows:

Count 1 alleges that, on August 20, 2003, Green used a credit card issued by Adams County to make a purchase for his personal use in the amount of $32.68 from Campo’s Fast and Easy #2.

Count 2 alleges that, on August 25, 2003, Green used a credit card issued by Adams County to make a purchase for his personal use in the amount of $18.55 from America’s Best Contact.

Count 3 alleges that, on November 27, 2003, Green presented a Wells Fargo credit card statement for $51.23 making a false claim that it was payable as a public expense.

Count 4 alleges that, on November 4, 2004, Green used a credit card issued by Adams County to make a purchase for his personal use in the amount of $65.40 from the Holiday Inn.

Count 5 alleges that, on November 5, 2004, Green used a credit card issued by Adams County to make a purchase for his personal use in the amount of $65.40 from the Holiday Inn.

Count 6 alleges that, on November 27, 2004, Green presented a Wells Fargo credit card statement for two transactions of $65.40 making a false claim that it was payable as a public expense.

Count 7 alleges that, on November 23, 2004, Green used a credit card issued by Adams County to make a purchase for his personal use in the amount of $176.75 from V-1 Propane.

Count 8 alleges that, on December 27, 2004, Green presented a Wells Fargo credit card statement for $176.75 making a false claim that it was payable as a public expense.

Count 9 alleges that, on or between December 23, 2004, and January 25, 2005, Green used a credit card issued by Adams County to make nine purchases for his personal use in the amount of $888.85.

Under Idaho law, the maximum penalty for misuse of public funds is ten years in prison. The maximum penalty for presentation of a fraudulent account is five years in prison. Persons convicted of misuse of public funds are prohibited from holding public office in Idaho.

The complaint was filed today in the Adams County Magistrate Court. Green will appear in magistrate court on March 14, 2006.

Attorney General Lawrence Wasden said the case is being prosecuted at the request of Adams County Prosecuting Attorney Myron Dan Gabbert.

The Attorney General said that the complaint filed is merely a formal accusation and that persons accused of crimes are presumed innocent until proven guilty beyond a reasonable doubt in a court of law.
