Attorney General Obtains Refunds for DISH Network’s Idaho Customers

(Boise) – Eligible Idaho consumers will receive refunds as a result of a $5.9 million legal settlement with DISH Network, Attorney General Lawrence Wasden said today. In addition, DISH Network L.L.C. will pay the State of Idaho $125,000 to settle allegations that the satellite television company engaged in deceptive business practices.

An investigation of DISH Network by Wasden and 45 other states uncovered numerous alleged violations of Idaho’s Consumer Protection Act and Telephone Solicitations Act.

Idaho consumers have filed 179 complaints about DISH Network with Attorney General Wasden’s office since 2004.

“In addition to reimbursing consumers for their losses, this settlement requires DISH Network to change how it does business in Idaho,” Attorney General Wasden said.

The settlement resolves the states’ allegations that DISH Network:

  • refused to accept responsibility for the misconduct of its third-party retailers and installers;
  • made telemarketing calls to consumers in violation of do-not-call rules;
  • failed to disclose all terms and conditions of their customer agreements, including the availability of rebates, credits and free offers;
  • did not disclose that purchased or leased equipment was previously used and/or refurbished;
  • made reference to competitors’ price offers when the goods or services being compared were materially different; and
  • charged customer credit cards and debited bank accounts without providing adequate notice and obtaining appropriate authorization.

DISH Network denied any wrongdoing.

Consumers who complained in writing to DISH Network or who filed a complaint with the Attorney General’s Office between January 1, 2004, and July 9, 2009, are eligible to receive restitution. Consumers in this category do not need to take any further action at this time. DISH Network will notify consumers that they are eligible for the restitution program by sending a claims notice to those consumers.

In addition, Idaho consumers who file complaints with the Attorney General or DISH Network by December 14, 2009, may be eligible for restitution if DISH Network’s conduct occurred within the past two years. Consumers who are not satisfied with the company’s offer of restitution may choose to file a claim to be decided by a third-party claims administrator.
