Anyone planning to make unsolicited telephone calls to potential purchasers or investors must first register with the Attorney General’s Consumer Protection Division. Telephone solicitors may print and mail their registration materials to the office.
If a telephone solicitor fails to register as required, the solicitor not only violates Idaho law, it cannot enforce any contracts entered into as a result of the unlawful telephone solicitation. Because the consequences of not registering are significant, it is in the telephone solicitor’s best interests to understand the requirements of Idaho law, promptly comply with those requirements, and consult closely with experienced legal counsel before, during and after registration.
